This LAON's 6th Review contains the latest information on the stage at which applications for 22 potential opencast mines has reached, 14 in England, 5 in Wales and 2 in Scotland. It also contains a link to a research paper which indicates what the effect would be of introducing a 'buffer zone' of varying widths around Opencast sites on two British Coalfields.

Banks Group finally submits their plans for a 752,000 tonne site, offering £75,000 for community benefits.. Site will be worked for 3 years. Local people are to have a Public Meeting to discuss the plans. A recent poll indicated that 66% of local residents were against any more opencast mining as the area has had 60years experience of the industry. See

HOODSCLOSE Whittonstall (Northumberland County Council) (Application) (UK Coal) (2.2m tonnes + 500,000 tonnes of fireclay)

UK Coal hopes to extract 2.2m tonnes of coal and 500,000 tonnes of fireclay over a seven year period. The Scoping Inquiry state began soon after August 2009 with an application following in 2010. This is still a live application.

‘UK Coal tempts village with a £1.25m sweetener’ (Hexham Courant, 26/10/12)

UK Coal hopes that an offer to extend the local primary school by building a £850,000 extension to the local primary school, Whittonstal First School and the offer of other benefits totalling £1,25, will soften the degree of local hostility that has greeted the Company’s plans for an opencast site here. Two quotes may illustrate local feeling

“However, there were no guarantees there would be no future applications to extend the site to neighbouring communities such as Hedley – an issue which has been of major concern.”

“While some felt the creation of up to 76 full-time jobs and a number of apprenticeship schemes within the area would be positive, others may well feel the £1.25 sweetener smacked of bribery.”

The local community is being short changed by this offer as generous as it may seem. To gain ‘acceptability’ for the Minorca site in 2011, UK Coal offered payments in cash and kind worth a total of £2.75m to extract 1.5m tonnes of coal. This is equal to £1.83 per tonne. For 2.2m tonnes of coal here, UK Coal is offering £1.25m, equal to 0.57p per tonne. See

‘Opencast plan could hit Whittonstall First School’ (Journal 29/10/12)

The Whittonstall Action Group suggest that parents might withdraw their children from attending the school if permission is granted to UK Coal for them to mine within 165 meters from the school. The school is to benefit from UK Coal if permission is granted by Northumberland County Council who will provide £850,000 for a school extension. See

MINORCA NORTH (Leicestershire, Leicestershire County Council, UK Coal, Amount of estimated coal reserves not published, Stage: Exploratory Drilling)

The Minorca Opencast Protest Group, through my research has now found out that in February, UK Coal had applied for a licence from the Coal Authority undertake exploratory drilling to assess the coal reserves available on land adjacent to the current Minorca site.

‘Residents fear for the safety of their homes’ (Ashby Times, 26/10/12)

News item on how residents living in a relatively isolated group of houses have reacted to the prospecting activity of UK Coal as they continue to explore the size of the coal reserve next to the Minorca site. Some of the residents, who are tenants of a housing association, were afraid that their landlord might be willing to sell their houses to UK Coal and leave them homeless. However, Jerry Sykes, Communications Officer for the East Midands Housing group said
“I can confirm that we have no plan to sell the properties at Measham Hall. Neither is it our policy to sell tenanted properties”

UK Coal has applied to mine 1,275,000 tonnes of coal over a 5yr period on a Greenfield site.

The Duke of Buccleuch’s private company Buccleuch Group and Kier Minerals are applying for what appears to be an exploratory licence to see if it is worth developing a surface coal mine on the Canonbie coal field. See

‘Opencast plans transported a stage further’ (Fife Today, 11/10/12)

A plan for Hall’s to extract 800,000 tonnes of coal near their existing Earlseat site clears another stage in gaining final approval. This application has the backing of the Levenmouth Area Committee and Fife Council. It is now subject to the legal conditions being approved and the approval of Scottish Ministers.Site to be worked for 4 years. See

Celtic Energy is to mount 3 new public exhibitions on their revised plans for developing the Bryn Defaid Surface Mine. This second round of consultations is due to take place at the following locations:

October 30th from 3pm-8pm at Heolgering Community School, Heolgering Road, Merthyr Tydfil

November 12th -17th , Hirwaun Library, High St, Hirwaun.

November 19th – 24th, Aberdare Library, Green St. Aberdare

Surface Miner Miller Argent have announced their intention to submit a planning application for a 9.0m tonne opencast site at Nant Llesg, This is a site near to Caerphilly and the infamous Ffos-y-Fran site. A local group, the Green Valleys Alliance has already been formed to oppose any application.

‘’Garden city’ plan for Margam opencast site’ (BBC South West Wales, 11/10/12
One of a few news reports on this imaginative plan (The Big Picture Project) by Oak Developments to regenerate the site. Buried in the project is a plan to continue to mine this site for a further 1.5m tonnes for three years. Plan gets a mixed reception from local councillors.

FURTHER RESEARCH REVEALED THESE PREVIOUS NEWS STORY ABOUT THIS SITE

‘Residents in new mining concerns ‘(Wales on Line, 12/7/12)

Provides a summary of recent developments associated with this site. It was an unrestored site that had not been worked for some years. Celtic Energy were refused an application to extend the site in 2011 after a Public Inquiry and a Judicial Review. Now residents fear that a new restoration proposal will include new plans to extend the mine – fears realised with the new announcement on 11/10/12

COMMENT : I’m not exactly clear about what is going on here for the future, whether this is effectively the announcement of a Scoping Inquiry for an extension. However it seems that this site has been worked continuously since at least 1988, when a previous extension to the Parc Slip site was mooted. See

In addition, when Celtic Energy, the previous owners, lost their previous appeal to extend the site in 2011 after an Appeal Court Hearing, the judgement comments raised questions about the strength of the guidance on Wales’s 500m buffer Zone policy as highlighted in the news story:

“In appealing against the refusal, the company argued the Welsh Government’s policy to exclude mining within 500 metres of homes was flawed.

The Court of Appeal judgement said Welsh Ministers were entitled on the evidence to take the view that “the savings that would be made by using coal from the appeal sites would not outweigh the objections to the proposed development”.
However, the judges went on to refer to a clash between the 500-metre exclusion zone set out in the Welsh Government’s technical advice note MTAN2 and the 200-metre exclusion zone specified in Neath Port Talbot council’s local development plan (LDP).

The judgement said: “Development control is development plan led, and decision makers need to ask themselves the question whether the development plan provision on such a basic point is overruled by a Ministerial technical advice note.
“MTAN2 does... direct attention to LDP policy, and it is not obvious that the 500-metre zone immediately replaces LDP provisions. Further guidance would have been helpful.”

According to the judges, it would be difficult for decision makers to ignore the advice note, given the source from which it came.” See

NEW VARTEG (Torfaen Council), (Public Inquiry), (Glamorgan Power) (325,000 tonnes)

This is a catching up exercise on this long going planning application which started in either 2008 or 2009. Torfaen Council has rejected the application and a Public Inquiry sat at the beginning of this year. The results of that Public Inquiry are awaited. NEWS EXTRA: CUTACRE, BOLTON

This is a controversial UK Coal site which is now undergoing restoration and some further development as permission has been given to build on part of the site. However , as the news item below illustrates, they have had a problem.

‘Flooding is ‘under control’ in Tyldesley’ (Leigh Journal, 28/10/12)

A stream which had been diverted to enable the Cutacre site to be worked recently changed it course after a heavy storm, blocked up a culvert, caused local flooding and deposited hundreds of tonnes of sand on farmland, Now the situation is to be remedied and is ‘under control’. See
