The Fray Bartolomé de Las Casas Human Rights Centre (Frayba) has stated that the Mexican State violated due process against the indigenous Francisco Sántiz López, support base of the Zapatista Army of National Liberation (EZLN), who has been imprisoned since 4 December, charged with carrying a weapon for the exclusive use of the Mexican Army and Armed Forces.
“The number of rights violated is evidence of the persecution of Sántiz Lopez for the political work he has been performing in the Highlands of Chiapas, so there is a justified fear that the first district judge of federal criminal prosecution in the state of Chiapas could issue a guilty conviction against him”, they said in a statement.
Frayba consider that “the Mexican state is using the system of law enforcement and justice administration to criminalize the EZLN support bases, because they are troubled by the progress in the right to self-determination through Zapatista autonomy, based on the San Andres Accords and international benchmarks: International Labour Organization Convention 169 and the United Nations Declaration on the Rights of Indigenous Peoples.
The indigenous Tzeltal was arrested on November 4 in the municipal seat of Tenejapa after an attack in which a PRI militant was killed in the community of Banabil. According to witnesses, Sántiz Lopez was not at the scene of the events.

El Centro de Derechos Humanos Fray Bartolomé de Las Casas (Frayba) afirmó que el Estado mexicano ha violado el debido proceso contra el indígena Francisco Santiz López, base de apoyo del Ejército Zapatista de Liberación Nacional (EZLN), preso desde el 4 de diciembre pasado, acusado de portación de arma de uso exclusivo del Ejército Mexicano y Fuerzas Armadas.
El cúmulo de derechos violados evidencia que se trata de una persecución por el trabajo político que realiza Santiz López en los Altos de Chiapas, por lo que existe el temor fundado de que el juez primero de distrito de procesos penales federales en el estado de Chiapas emita una sentencia condenatoria en su contra, aseveró en un comunicado.
El Frayba consideró que el Estado mexicano utiliza el sistema de procuración y de administración de justicia para criminalizar a bases de apoyo del EZLN, debido a que le molestan los avances en el derecho a su libre determinación a través de la autonomía zapatista, con base en los acuerdo de San Andrés y sus referentes internacionales: el Convenio 169 de la Organización Internacional del Trabajo y la Declaración de la Organización de Naciones Unidas sobre de los Derechos de los Pueblos Indígenas.
El indígena tzeltal fue detenido el 4 de noviembre en la cabecera municipal de Tenejapa, luego de una agresión en la que murió un militante priísta en la comunidad de Banabil. De acuerdo con testigos, Santiz López no estaba en el lugar de los hechos.
