International infiltration of protest movements to be investigated

“I appeal to the Icelandic authorities to bring to light, in their investigations, the covert activities of foreign police in Iceland. Given that the British police spy Mark Kennedy was active not only in Germany, but also in France, Italy, Poland, Ireland and Iceland, it is obvious that these operations targeted left-wing activists with international links,” said Andrej Hunko, Member of the German Parliament, after gathering new evidence on Kennedy’s activities in Iceland.

Hunko continued:

"I’m glad to see investigations by activists and parliamentarians in their countries to uncover the cross-border efforts to infiltrate anti-capitalist groups. But most interior ministries in the EU member states are remaining silent about their cooperation or are giving conflicting responses.

I'm also glad that the Icelandic minister of the interior has instructed the police to file a report about Mark Kennedy’s infiltration of the Saving Iceland network. After examining more evidence provided by Saving Iceland last week, including a photo that shows Kennedy with Icelandic police officers, it seems that the authorities were at least aware of British undercover police infiltrating the protests against the Kárahnjúkar dams.

In Germany, Mark Kennedy fooled both activists and the police by setting fire to a dumpster at a demonstration. Committing crimes is forbidden for police officers in Germany and in Great Britain.

The local Berlin police were not informed about Kennedy’s true identity, according to the Berlin senator with responsibility for the police, Erhard Körting. Even Berlin’s public prosecution office, which investigated the fire, was deceived and given the false name of ‘Mark Stone’. The legal proceedings were later dropped on the grounds that the arson was considered a ‘minor crime’.

The German Government has now said in its answer to my recent parliamentary question that spying on protest movements has the purpose of proactive monitoring of potential future wrongdoing, implying that there is a link between anti-globalisation protests and parcel bombs. The chief of Germany’s Federal Criminal Police Office, Jörg Ziercke, told parliamentarians at a secret meeting that the police must act ‘covertly and internationally’ in future to fight against so-called ‘euro-anarchists’.

I am keen to read the Icelandic report soon, which hopefully will shed more light on the involvement of foreign police forces in British spying on protest movements. If the Icelandic police were not informed about the activities of foreign undercover police officers, this would represent a breach of international law and would have to be prosecuted.

Targeting protesters as ‘extremists’ and infiltrating them without respecting their privacy is a violation of their civil rights. If Kennedy recorded conversations, this would, I imagine, be another breach of the law, also in Iceland.

Following the revelation that British spies even engaged in relationships for tactical reasons in order to gain access to information, the British Home Office stripped the National Public Order Intelligence Unit (NPOIU) of its power to run undercover operations. The NPOIU is part of a police body that is known to have collected at least 2000 dossiers on left-wing activists. I am told by Saving Iceland that the Icelandic police have confirmed that they had relations with UK police forces regarding common workshops.

I hope that the foreign affairs and interior ministers, Össur Skarphéðinsson and Ögmundur Jónasson, will help to reveal the infiltration of protest movements. I appeal to the Icelandic police to make more details public and to respect activists’ demands for disclosure of any information that was collected about them.

National and international activists who were spied on by foreign and Icelandic police forces have the right to be notified of the surveillance after the fact.”

Spies of all countries

Matthias Monroy 13/05/2011

Police forces of many countries organize their exchange undercover since 2001. Germany has played a fundamental informal structures

After the federal government a few weeks with the meaningless answer to a parliamentary initiative [1] on the use of undercover investigators inside and investigators as well as trusted third parties in national, European and international context "came up, is now at least some light on the still nebulous border spy cooperation: In its more than two months of processing the request "International Exchange and female undercover investigators and spokespersons," explains [2], as the police forces of EU Member States, cross-border joint arrange for spying.

Within the EU very advanced cross-border police co-operation so far is based, inter alia, the Convention on Mutual Assistance in Criminal Matters [3] (Rh-UEBK EU), the Council of Ministers had adopted ten years ago the EU.

An agreement between the Federal Republic of Germany and the USA on Mutual Assistance in Criminal Matters also includes a corresponding general formulation. Nevertheless, many schemes remain open. Therefore, the German EU presidency started in 2007 an initiative to evacuate to "legal and factual issues" of international spies out of the way exchange. Were targeted for a problem analysis of EU-wide legislative measures. The contract for the drafting of a resolution of the Council had received the previous "Multidisciplinary Group on Organised Crime, which is now in the" General Affairs Working Group and evaluations "succeeds.

Until now, however, is no movement in the legislative embodiment of the spy-operation come (with false papers to "Euro-anarchists" [4]). Is now clear that the cooperation behind the scenes has been practiced for much longer.

Cooperation with Russia, Turkey and Ukraine

Responsible for international agreement on "use and exchange of undercover" the "European Cooperation Group on Undercover Activities" is (ECG), to work on the German side as "central services for undercover investigators," the Federal Criminal Police (BKA) and the Customs Criminal Office . The aim will "professionalize and coordinate international cooperation in the use of undercover investigators is. As the "main topics" refers to the fight against "organized" and "politically motivated" crime.

The ECG, according to a federal government since 2001, their rhythm is meeting once a year, meetings are held in a different ECG-Member State. Its membership includes almost all EU countries, allegedly with the exception of Greece, Ireland, Luxembourg, Malta and Cyprus. International organizations such as Interpol and Europol were like "private legal entities" not involved.

But the informal group is far from limited to the EU: The other members are Albania, Croatia, Macedonia, Norway, Russia, Serbia, Switzerland, Turkey and Ukraine are represented. Here, the ECG according to the Federal Government "in any national or international institution / organization affiliated" and therefore not accountable to the European Union. Thus, it can not be controlled by the EU Parliament, but most by the parliaments of the Member States. By the autumn of last year was their existence to the search engine and thus probably the parliamentarians unknown.

The "European Cooperation Group on Undercover Activities" first met in Poland, even then created as an informal "Eastern and Western Europe overall meeting. A follow-up meeting in 2002 in Belgium perpetuated the working group. Further meetings were held in the Czech Republic (2003), Croatia (2004), Hungary (2005), Germany (2006), Lithuania (2007), Turkey (2008), The Netherlands (2009) and Russia (2010). The meetings serve "Presentation of the current national situation," on the agenda are the "Identification of legal, structural and organizational development" and "information on training".

According to the Federal Government maintains it is not "co-ordination or appointment of cross-border operations" on the agenda. That sounds played down, especially since it is from Berlin that "the discussion of international cooperation" also based on "case studies" would be made. The emerging within the working group contacts should also be fundamental for the respective bilateral or multilateral arrangement of future bets.

To synchronize the interaction between the sending and receiving country better, the ECG was commissioned in 2003 a working group to draw up a final model agreement. Details such as the memory that foreign policemen should not commit crimes, are now regulated in a standardized, for each application completed bilateral Memorandum of Understanding (MoU). This "paper" Establishment of the jointly developed principles for international cooperation ", the ECG was presented in 2004 by police officers from Germany, Great Britain, Denmark, Belgium, Romania and Finland. The discussions will be in the MoU also, as a measure in the event of her flying up to the public to be justified, or whether emissions of "Agents Provocateur" are possible.

Previously, the federal government already existence of a "Cross-Border Surveillance Working Group (CSW) confirmed that to which Europol is also involved [5]. Their activities, however, remains in the dark: the response [6] to a previous question on cross-border investigate private computer systems were allayed, that twice a year for days be CSW "lectures on cross-border surveillance" to be held in order to optimize work processes "to achieve" a . In addition to the "operational and tactical opportunities" if the "legal framework" of different countries presented.

Europol, however explained to CSW, its purpose is the development of "safe and effective monitoring techniques. This is now echoed by the federal government and states, trade is a "platform for discussions".

Federal Criminal Police Office as an international "broker" for regional police forces

The BKA has taught the use of British spies, according to its president Joerg Ziercke to the state police from Mecklenburg-Western Pomerania and Baden-Wuerttemberg on, where the G8 or NATO summit was held.

According to the BKA-law, the Office is generally responsible for the service of traffic police forces of the Federation and the countries with "public services" of other states. Exceptions such as for emergencies, or relating to "crime of regional significance in the border area" is provided.

Because of their competence, it is usually impossible from the federal government gave more information on missions to obtain. The state governments give again unbuttoned. Mecklenburg-Vorpommern shares [7], after all, that "Mark Kennedy and Mark Stone of the British" National Public Order Intelligence Unit (NPOIU) was sent. An agreement between the competent authorities of the British police and the competent authority of the State Police of Mecklenburg-Vorpommern "regulated features, including that" employment-related expenses (eg travel - accommodation and subsistence costs) reimbursed ", but were apparently no further donations flowed.

The operation in Mecklenburg-Vorpommern was based on a conceptual framework [8] "Implementation of coordinated police action by the states and the federal government on the occasion of the German G8 Presidency in 2007, and the German EU Presidency in the first half of 2007, which also "Implementation of hidden police measures" envisaged.

From a non-public meeting of the Interior Committee of the Parliament of Mecklenburg-Western Pomerania shows that recommended in the framework concept "the increased use of informants and the use of informants and undercover people." Is explicitly promote cooperation with other governments: should be so used "where appropriate and within the legal options and foreign persons, or undercover agents."

"Use of terms" are "coordinated with foreign security services" in individual cases between the states and the Federal Criminal Police Office, said "the increased number of relevant findings and the consistent application of preventive police measures" remained paramount. In fact, to hear from informed point that for the G8 summit in Heiligendamm more than ten foreign police or trusted third parties sniffing in Germany.

"Optimization work"

For legalization of the German spy system countries have the interior and justice ministers of the joint directive [9] on the "use of informants and the use of officers and undercover investigators as part of the prosecution" closed one, which, however, no detailed rules for police officers from the international meets.

German police officers rely on a decision of the Bundesgerichtshof (BGH), which decided in 2007 [10] that a "hidden inserted foreign police officer" is to be regarded as a police spokesperson. Their status is therefore a private individual, whose term at some length with the police a third party is not known.

However, it is the Supreme Court's decision by no means a landmark ruling, instead, wanted the court to clarify whether only usable by a foreign police obtained evidence in judicial proceedings would be. Moreover, the judge referred to a law enforcement operation to what the federal government will summarily be valid also for alleged security.

The foreign police officers are subject to other restrictions so as German police spies. However, they may, according to Home Office [11] as well as their German colleagues, no love affairs or sexual affairs divulging use to as this "core areas of private life" in breach of the. This is even by internal guidelines of the Federal Criminal expressly prohibited and applies - at least in the area of federal - as well as undercover police spokespersons. For "tactical romantic relationships" with "Mr. Kennedy" were the Federal Government in May, no information.

To sort the mess of the legal status of foreign spies in favor of the prosecution authorities, the BKA is now proposed to the police bodies of the Conference of Interior Ministers of the countries to evaluate the "current practice under the covert use of foreign police officers in Germany" and "to develop relevant, any optimization ".

The BKA does so far as a "broker" of requests for the use of foreign spies, police and given them by the state police forces. The Federal Office has national authorities so that the opportunity to deepen their own channels allows: the countries police forces can now have their own "direct contacts abroad" [12] to organize their "time-intensive international cooperation between" use.

Awarded to Great Britain, according to German police officers are federal government by the British National Public Order Intelligence Unit (NPOIU) had been "including" required for the summit in Gleneagles, Scotland. Such exchange was a spy, according to Commissioner of Police Ziercke usual and would be followed even with "hooligans, in the context of the World Championships or other major sporting events."

The increasing deployment of German police officers abroad are under the direction of the country's interior ministry and serve mostly law enforcement or assistance in establishing or maintaining the false identity ("Legend"), security operations are rare.

Police cooperation with Britain, by virtue of federal government had there with the Serious Organised Crime Agency (SOCA), instead of "Her Majesty's Revenue and Customs (HMRC) and the Metropolitan Police and Scotland Yard. On the question of who occupies the office of NPOIU after it may lead, partly because of scandalous investigative methods no longer a spy, was the federal government and its authorities "no change given" was.

Letter bombs as a justification for use at summit protests

Ziercke had told the deputies in the Interior Committee, EU Member States would launch its spy against "Euro-anarchists, militant left-wing extremists and terrorists" in position, the organized allegedly in Greece, Spain, Great Britain, France, Denmark and Germany.

Although the known spying were all carried out around the summit protests, they are made subsequently with other offenses. The federal government writes the "Europeanisation of the anarchist scene" was visible in the "cross-border shipment of letter bombs" or "transnational coordinated commission of serious attacks." The Ziercke as a justification of international spy missions cited alleged violation "of more than 400 police officers" at the opening demonstration against the G8 summit on 2 June 2007 in Rostock is tendentious, and the claim is by journalists such as civil rights activists long since been refuted [13] - the majority of police forces stand in their own tear gas spray.

For the work of spies, it would "always praise the part of the policy indicate Ziercke had appeased the Interior Committee of the Bundestag in January. Upon request, the source of this praise, the Federal Government rows back now: meant was a "trouble-free history" that the "schedule prepared and considered police action" would be attributed. "Criminal Police special forces" such as undercover agents were "obvious reasons" not specifically mentioned.

Neither previous G8 summits still on the NATO summit in Strasbourg would like the federal government more detailed information on sending countries and recipients make the spy. Not yet been flown spy should be protected as they move in "criminal and terrorist environments," whose members were distinguished "by a high degree of state distance, and criminalization of aggression and violence potential." A political assessment of the criminalization of summit protesters remains failed because a back seat "aspects of the welfare state and the protection of fundamental rights of third parties" to the parliamentary control law.

No information on police intelligence methods

An announcement of the real name was indeed "as long as those officials do not like in the case of Mark Kennedy and Mark Stone have been unmasked in public" to avoid in any case. Nevertheless, the federal government is silent on the affair of the use of Kennedy; explosive details remain secret protection agency of the Federal Parliament under lock and ambiguities on demand repeatedly put forward ambiguous and unresolved. Also on the question of the consequences of Kennedy committed the crime in Germany is acknowledged scarce, the "matter" is "discussed with the relevant authorities on the British side" was. The necessary law enforcement or legal steps have been taken yet, therefore.

As well as the role remains open international police organizations. While the Commissioner of Police said the Interior Committee, Europol was aware of Mark Kennedy, said the federal government that they worked together at the spy exchange "not even with Interpol and Europol. Here is Europol certainly always on the go in that range, the spies out research is the by: The Europol annual Report "Trend Analysis" to terrorism in the EU [14] explained in 2010, the "anarchist extremists" would, especially in the areas of anti-capitalism, anti-militarism and "No Borders" involved. In several countries would be added and environmental issues and the concern with climate change, and squatting or migration.

The competent national police forces like the German Federal reserve by the cooperation in international structures, a clear overview of the international exchange of spies and are, as the German example shows, undercover uncontrollable "brokers" cross-border cooperation. Although they have not received any new skills, but they work in informal working groups to improve the framework conditions for international missions. Their parliamentary control is more difficult: the way information is transmitted by foreign spies to not pursue further information would be obtained only by the parliaments of the sending countries.

At the same time signs of a growing intelligence formation of criminal investigation methods, if forbidden "scene typical offenses" committed to the seemingly ruthless "legend" and any law enforcement only "discussed in the competent bodies" is.

The legal education is also compromised if it is not clear where about one in Germany ever addressed to vice-border criminal complaint must be: If in the case of crimes committed by Mark Kennedy arson Himself to prosecute his superiors of the British NPOIU whose private law guide the Association of Chief Police Officers (ACPO), the German Federal Criminal Police Office as a "broker" of cooperation or the state of Berlin, where the use of fire for alleged "legends" take place?
