Australia: The Law Council of Australia is warning that the Federal Government must learn from its mistakes over Guantanamo Bay?
Even though the governments was complicit, had intention, and the fact that they overlooked these crimes?
It says recent developments including judicial criticism of the US military commissions and the release of Mamdouh Habib have placed unprecedented pressures on the credibility of the administrative and legal system.
Law Council president John North says the Government must act when Australian citizens are being detained in foreign countries without charge.
"The credibility of the legal system is not just within Australia, Australia's very image in the whole world is badly affected when we do not support our citizens," he said.
"The mistake is to leave Australian citizens in prison in foreign countries without them even being charged.
"It leaves us open to international condemnation and it leaves us, as Australians citizens, without faith in our own government."
Not just that it makes the government guilty of crimes punishable by law. Who's going prosecute the federal criminals?
The 'Community' is waiting for the prosecution of these offenders. The offenders of these premeditated, vicious and callous crimes should be charged with the offences they have been alleged to have committed.
Mr Habib should complete a record of interview taken by the police. Then the police should take his statement, and record of interview and lay charges against the offenders and co-offenders of this premeditated torture. Then all we need is a jury.
Adelaide man David Hicks is still being detained in Guantanamo and has been charged by US authorities.

But no one can say the same about the act of taunting Mamdouh Habib in Australia before he was kidnapped by the US and then tortured. Nor can they say the same about the Australian Governments complicity in his torture by the US.
