Hacemos un llamado urgente de solidaridad internacionalista con los trabajadores del Colegio de Bachilleres (CB) de México que estamos llevando adelante una decidida lucha contra la violación al contrato colectivo de trabajo y por mejoras en las condiciones laborales.
SOLIDARIDAD URGENTE CON LA LUCHA DE LOS TRABAJADORES DEL COLEGIO DE BACHILLERES

Hacemos un llamado urgente de solidaridad internacionalista con los trabajadores del Colegio de Bachilleres (CB) de la Ciudad de México y del Estado de México que estamos llevando adelante una firme y decidida lucha contra la violación al contrato colectivo de trabajo y por mejoras concretas en nuestras condiciones laborales. El CB cuenta con más de 120 mil estudiantes y seis mil académicos de los 20 planteles en el DF y Estado de México. Tiene instalaciones en 24 estados del país.
Es la quinta huelga que nos vemos obligados a protagonizar en cuatro años contra los ataques de la política antiobrera y neoliberal del reaccionario gobierno de Vicente Fox. Después de 22 días de huelga las autoridades educativas y el gobierno Foxista siguen sin ofrecer solución al conflicto. Se demandó en tiempo y forma a las autoridades del CB el respeto al Contrato Colectivo de Trabajo, (CCT) particularmente en lo que corresponde a las cláusulas 68 y sus correlativas, 124, 125 y 130, que se refieren al pago con salario integrado (y no como pretenden las autoridades con un tope salarial de dos salarios mínimos) para los trabajadores que se jubilan, que renuncian o que cuando algún trabajador fallece se pague a sus deudos, tras 15 años de laborar, correspondiéndole 12 días por año trabajado. Pero las autoridades no han querido pagar y de manera cínica dicen que las demandas de los trabajadores tienen un sustento legal, por lo que si demandan individualmente pueden ganarles en un juicio. Situación que es violatoria de nuestro contrato colectivo de trabajo.
Cabe mencionar que la violación de la cláusula 68 no es la única, CB viola reiteradamente nuestro Contrato Colectivo de Trabajo: no han autorizado la creación de nuevas plazas para los planteles donde se hicieron ampliaciones, por lo que se está atendiendo a un mayor número de estudiantes y quieren que sigamos trabajando con la misma planta de trabajadores; además incurre en la sustracción de la materia de trabajo en las oficinas generales, por lo que exigimos que no se subcontraten tareas que deberían ser realizadas por trabajadores sindicalizados. El director general del Colegio de Bachilleres, Jorge González Teyssier, afirmó ante la prensa cínicamente: "ni quiero ni puedo aceptar" la cláusula 68 del contrato colectivo. ""No hay posibilidad de llegar a un acuerdo sobre la cláusula 68, porque nosotros exigimos que la acompañe una resolución judicial, ya sea mediante juicios individuales o por arbitraje". En este sentido, afirmó que él no gestionará los recursos que soporten el costo de esa prestación, porque "no admito que yo la otorgué" en la pasada revisión del contrato colectivo, en diciembre, siendo que su firma se encuentra en el documento del vigente Contrato Colectivo.
Desde hace 2 años los trabajadores de CB hemos estado en continua lucha ante los embates de las autoridades. Durante este periodo hemos dado pasos adelante en el plano organizativo y plasmando diferentes logros en el CCT. En los últimos 2 años hemos conseguido en el CCT: el vale para libros, la compactación en un solo turno de los horarios de los trabajadores de fotocopiado y cardistas, aumentar el pago de los días económicos no disfrutados y el pago de la cláusula 68 con salario integrado para los jubilados, que ahora es violada, y además una mesa académica de diálogo. Desde el año pasado se ha venido desarrollando el movimiento de jubilados por el pago justo de las jubilaciones. La persistencia de los compañeros jubilados logró por un lado plasmar en el CCT firmado a finales de 2004 el pago de las jubilaciones con salario integrado y más tarde, concienciarnos y aglutinarnos en torno al cumplimiento de la cláusula 68. El partido de izquierda de masas en México, el Partido de la Revolución Democrática (PRD), ha solicitado a la Secretaría de Educación Pública (SEP) que resuelva favorablemente las justas reivindicaciones del Sindicato Independiente Nacional de Trabajadores del Colegio de Bachilleres (SNITCB). Esta semana presentará un punto de moción para debatir la cuestión en la Cámara de Diputados. Los principales sindicatos independientes y democráticos del país, como la Unión Nacional de Trabajadores, se han solidarizado públicamente con el movimiento.
A esta situación se suma la cerrazón de las autoridades educativas y la actitud agresiva y perversa de Hacienda de no liberar los recursos aprobados por la Cámara de diputados para la nivelación salarial de los trabajadores de educación media superior (CB y Cecyt). Están obligando al estallido de un paro nacional en los 24 estados donde hay Colegio de Bachilleres, y en las 20 entidades donde están los Colegios de Estudios Científicos y Tecnológicos (Cecyt)
Este llamado es una forma de mostrar esa solidaridad. A continuación publicamos el modelo de resolución para exigir que el Colegio de Bachilleres, la SEP, Secretaría de Hacienda y Crédito Público (SHCP), Secretaría de Trabajo y Previsión Social (STPS) y el gobierno mexicano cumplan con el Contrato Colectivo de Trabajo legalmente firmado y vigente.
LLAMAMIENTO INTERNACIONAL
Las organizaciones y personas abajo firmantes queremos expresar nuestro apoyo a los trabajadores del Colegio de Bachilleres, quienes se encuentran en lucha desde hace más de 20 días por lograr el cumplimiento y no violación de su Contrato Colectivo, fundamentalmente en su cláusula 68, que se refiere al finiquito con pago de salario integral a todos los compañeros que se retiran a través de jubilación por renuncia o por muerte, y las correlativas, 124, 125, y 130; el pago del 100% de salarios caídos en la huelga, ya que son las autoridades del CB las responsables de la huelga; la creación de suficientes plazas laborales para los planteles en ampliación; y aumento salarial en la modalidad de nivelación salarial, liberando los recursos presupuestados por el Congreso para tal fin y congelados por el gobierno Fox.
El Estado mexicano ha sido exhibido y denunciado recientemente por organismos como el Banco Mundial, la ONU, y la OCDE por encontrarse en los últimos lugares en materia educativa a nivel internacional y no destinar suficientes recursos ni a infraestructura material ni a recursos humanos, cuando un 50% de la población se encuentra en la pobreza.
Seguiremos atentos la evolución de este conflicto laboral a la vez que llevaremos adelante campañas de denuncia en foros nacionales e internacionales, e informando ampliamente tanto a los trabajadores y estudiantes como a diferentes instituciones y organismos de la vida pública y política de nuestro país, y a la opinión pública en general, acerca de las verdaderas condiciones de falta de respeto a los derechos humanos y laborales que prevalecen en México bajo el gobierno de Vicente Fox Quesada, lo que contraviene sus declaraciones frecuentes sobre la existencia de un verdadero estado democrático en la República Mexicana.

El respeto de las autoridades del CB, de la SEP, de la Secretaría de Hacienda, de la SPS y del gobierno de Vicente Fox, al Contrato Colectivo de Trabajo vigente y la inmediata solución a las justas demandas planteadas por los trabajadores de Bachilleres y el sindicato, SNITCB:

It was demanded in time and it forms to the authorities of the CB the respect to the Collective Contract of Work, (CCT) particularly in which it corresponds to the clauses 68 and his corelative ones, which they talk about to the payment with wage integrated (and not as they try the authorities with a wage top of two minimum wages) for the workers which they retire, that resigns or that when some worker passes away pays to its relatives, after 15 years to toil, corresponding 12 days to him per worked 124, 125 and 130 year. WE DEMANDED: The respect of the authorities of the CB, the SEP, the Secretariat of Property, the SPS and the government of Vicente Fox, to the Collective Contract of effective Work and the immediate solution to the right demands raised by the workers of Bachelors and the union, SNITCB:
