INVESTIGATORS SLIP UP IN BRAD WILL CASE, WHILE SEVEN JOURNALISTS HURT IN OAXACA CLASHES WITH FEDERAL POLICE.

While noting that two of Indymedia cameraman Brad Will’s alleged killers were arrested and taken before a judge yesterday in Oaxaca, Reporters Without Borders today condemned the shortcomings in the investigation into his fatal shooting and the fact that three others allegedly involved have been able to escape.

The press freedom organisation also voiced outrage about the use of violence by the Federal Preventive Police (PFP) to disperse protesters in the past few days in Oaxaca, in the course of which five journalists were injured and two others were roughed up.

“Two of Will’s alleged killers may well be under arrest but three others, including two municipal policemen and a paramilitary, did not respond to a judicial summons and cannot be located,” Reporters Without Borders said. “The investigation in no way absolves the Oaxaca state government of responsibility in Will’s death and we reiterate our call for the creation of a federal commission of enquiry.”

The organisation added: “We also condemn the police brutality in which seven journalists were among the victims and we urge the federal authorities to punish those responsible.”

The two men arrested yesterday on the orders of the Oaxaca state prosecutor’s office for their alleged role in Will’s murder were Abel Santiago Zárate, a local elected representative of the Institutional Revolutionary Party (PRI), which controls the state government, and his chief bodyguard, Manuel Aguilar.

The national daily Milenio named the three other presumed killers who are now fugitives from justice as municipal policemen Carlos Soriano and Juan Carlos Sumano, and paramilitary gang member Pedro Carmona, who was identified by witnesses as the person who fired the shot that killed Will while he was covering a violent protest by teachers in Oaxaca on 27 October.

Yesterday’s violence took place when the PFP federal police entered the Oaxaca university campus and dismantled barricades put up by the Popular Assembly of the Peoples of Oaxaca (APPO), which has been protesting for five months to press demands for the removal of Oaxaca’s PRI governor, Ulises Ruiz Ortiz.

Among the approximately 60 people injured in the violence were photographer Jorge David Jaramillo Velásquez of the El Universal daily, photographers Miguel Dimayuga and Germán Canseco of the weekly Proceso and cameraman Jorge Brindis of the Canal 9 public TV station, who were hit by flying glass or petrol bombs.

Jaramillo was hospitalised in a serious condition, but his injuries are not life-threatening, Reporters Without Borders was told. Mario Mosqueda Hernández, a correspondent of the Centro de Medios Libres de México independent news agency was beaten and dragged along the ground by 10 federal policemen during yesterday’s incidents. He has injuries to the head, back and left arm.

Gilardo Mota of the local weekly Opinión told Agence France-Presse on 1 November that he was held for 48 hours and was roughed by federal police after being arrested on 30 October while photographing police in action. He was finally released after paying bail of 3,000 pesos (216 euros). On 31 October, police attacked photographer Alberto López Cruz of the local daily Extra and took his camera. The Centro de Medios Libres de México also reported that two Guatemalan journalists went missing yesterday.

OAXACA : FALLOS EN LA INVESTIGACIÓN SOBRE LA MUERTE DE BRAD WILL Y SIETE PERIODISTAS HERIDOS EN UNOS ENFRENTAMIENTOS CON LA POLICÍA FEDERAL

El 2 de noviembre fueron detenidos, y entregados a la justicia, dos de los presuntos asesinos del camarógrafo de Indymedia Brad Will, muerto por disparos el 27 de octubre de 2006, cuando cubría una violenta manifestación de maestros en Oaxaca. Sin embargo, Reporteros sin Fronteras denuncia los fallos de la investigación y la huída de otros presuntos asesinos. La organización manifiesta igualmente su indignación por la violenta represión de manifestaciones, por parte de la Policía Federal Preventiva (PFP), en las cuales han herido a cinco periodistas, y golpeado a otros dos.

“Es cierto que dos de los presuntos asesinos de Brad Will están detenidos pero otros tres, dos policías municipales y un paramilitar, no han acudido a la convocatoria de la justicia y están en paradero desconocido. La investigación no exonera en absoluto al gobierno del Estado de Oaxaca de sus eventuales responsabilidades en la muerte del camarógrafo de Indymedia, y reiteramos nuestro llamamiento para que, a este respecto, se cree una comisión federal de investigación. Condenamos igualmente la brutalidad policial sufrida por siete periodistas y pedimos a las autoridades federales que castiguen a los autores de esos abusos”, ha declarado Reporteros sin Fronteras.

El 2 de noviembre de 2006, la Procuraduría General de Justicia del Estado (PGJE) de Oaxaca anunció que había quedado establecida la responsabilidad de Abel Santiago Zárate, concejal del Partido Revolucionario Institucional (PRI, del que es miembro Ulises Ruiz Ortiz, gobernador del Estado de Oaxaca) y del jefe de su escolta, Manuel Aguilar, en la muerte de Brad Will. Los dos fueron detenidos ese mismo día, y presentados a la justicia.

Según el diario nacional Milenio, otros tres presuntos asesinos no han respondido a la convocatoria de la justicia y ahora se encuentran huidos. Se trata de los policías municipales Juan Carlos Soriano y Juan Carlos Sumano, y de Pedro Carmona, un paramilitar al que algunos testigos habrían identificado como autor del disparo que causó la muerte a Brad Will.

El mismo 2 de noviembre, las operaciones de desmantelamiento de las barricadas de la Asamblea Popular de los Pueblos de Oaxaca (APPO), llevadas a cabo por la Policía Federal Preventiva (PFP), y la entrada a la fuerza que efectuó esa misma policía en la Universidad de Oaxaca, se saldaron con sesenta heridos, entre los que se encuentran cinco periodistas. Jorge David Jaramillo Velásquez, fotógrafo del diario El Universal, Miguel Dimayuga y Germán Canseco, fotógrafos del semanario Proceso, y Jorge Brindis, camarógrafo del canal público Canal 9, fueron víctimas del lanzamiento de cócteles Molotov y fragmentos de vidrio. El primero fue hospitalizado en estado grave, aunque su vida no corre peligro, según las informaciones recogidas por Reporteros sin Fronteras. En el mismo momento, diez policías federales dieron una paliza y arrastraron por el suelo a Mario Mosqueda Hernández, corresponsal de la agencia independiente Centro de Medios Libres de México. Tiene heridas en la cabeza, la espalda y el brazo izquierdo.

El 1 de noviembre, Gilardo Mota, del semanario local Opinión, manifestó a la Agencia France-Presse que unos agentes de la PFP le tuvieron detenido durante cuarenta y ocho horas, y le golpearon. Al periodista le habían detenido el 30 de octubre, mientras tomaba fotos de unos policías en acción Quedó en libertad dos días más tarde tras pagar una fianza de 3.000 pesos, unos 216 euros. El 31 de octubre unos policías agredieron y quitaron la cámara de fotos a Alberto López Cruz, fotógrafo del diario local Extra. Finalmente, el Centro de Medios Libres de México señala la desaparición, desde el 2 de noviembre, de dos periodistas guatemaltecos.
