SOCPA - barbara tucker jailed for two weeks

yesterday morning barbara tucker was arrested in parliament square for alleged breach of police bail
after being held for about 29 hours, she eventually was brought before district judge snow at horseferry road who sentenced her to two weeks in prison

barbara, the peaceful lone woman campaigner in parliament square, was arrested on 26th february after shouting at alan duncan MP at the gates of parliament

she was held for nearly 20 hours at belgravia having been arrested by police under the MP's instruction for unauthorised protest.

she was then bailed to return to charing cross police station on wednesday, but she refused to comply, as she has numerous appeals and judicial reviews concurrent about the abuse of justice at the hands of charing cross.

yesterday morning, fifteen police officers turned up in parliament square to arrest her for breach of bail. she was held all day and all night, and eventually brought before district judge snow this afternoon.

judge snow has presided over several cases involving barbara before and is himself the subject ofseveral of her appeals and judicial reviews. given this past history, which includes several overturned decisions, it might have been appropriate for him to recuse himself, but he carried on and heard the prosecution, who have now completely dropped the socpa charge and turned it into a section 5 (causing alarm or distress).

he quickly found barbara guilty and sentenced her to two weeks imprisonment at holloway prison.

barbara's main "crime" is to continue to speak out against the iraq war and for the children who have died there in their tens of thousands. she refuses to be silenced by police violence, corrupt courts, or laws against freedom. although detained many times by police, this is the first time she faces jail. supporters are asked to send messages to her at holloway. more details to follow.

I'm confused: was Barbara sent down for breach of bail or for the alleged Section 5 Public Order Act offence? It sounds to me like a blatant case of abuse of process and malicious prosecution, totally lacking in proportionality and therefore unlawful. I hope and anticipate that an appeal, judicial review and private prosecution will be forthcoming. I'm sure that heads will roll for this: clearly their familiarity with the Human Rights Act 1998 is somewhat limited.

Bless you Barbara, you deserve a medal and more for services to humanity!

barbara was sentenced for breach of police bail

the police bail was in relation to the incident with alan duncan - at that time she was arrested and held for SOCPA offence, but in court yesterday, police dropped that and replaced it with the section 5 charge

however her prison sentence is for not giving herself in to the charing cross police on wednesday whatever they intended to charge her for

i'll try to get contact details for her today and post them for letters of support
