Attorney General denies young crime victim

Jennifer Nash | 17.10.2010 21:43 | Other Press | Repression | Social Struggles | World

Despite lobbying Labor Attorney General Cameron Dick for over eighteen months, urging and begging him to intervene in a human rights abuse and obstruction of justice case against a young, unrepresented Australian born bullied schoolboy, Mr Dick has persistently refused to assist an aggrieved mother, protesting and singlehandedly advocating on behalf of her abused son.

The Bligh Labor government, Mr Dick and her local state Labor representative, John Mickel, the speaker of parliament and a former Labor Transport minister, have continuously ignored and denied Australian citizen Jennifer Nash and her son, who has been consistently denied legal youth advocacy, electoral representation, media attention and access to public service on equal terms in his very own country.

Former Labor Prime Minister Kevin Rudd also doggedly ignored the family, but after Ms Nash approached Mr Rudd during a community cabinet forum last year, he apparently wrote to Queensland Premier Anna Bligh.

However, he has never personally acknowledged Ms Nash in writing and never responded to her letters and phone calls, despite being a fellow Queenslander and enthusiastically telling voters “Hi! My name is Kevin, I am from Queensland and I am here to help!”

In a letter dated 6 August 2009, Premier Anna Bligh’s Senior Policy Advisor, Nick Williams writes:

“Dear Ms Nash, Your letter addressed to the Honourable Kevin Rudd MP, Prime Minister concerning the Queensland judicial system has been referred to the Premier for response. I have been requested to reply to you on the Premier’s behalf. The contents of your letter have been noted. This matter has been referred to the Honourable Cameron Dick MP, Attorney-General and Minister for Industrial Relations for consideration and reply direct to you. The Premier trust this arrangement is satisfactory to you. Yours sincerely, Nick Williams, Senior Policy Advisor.”

On 17 March 2010, an exasperated Ms Nash confronted Attorney General Cameron Dick at the Radio 4BC Right to Feel Safe forum in front of three hundred people, Police Minister Neil Roberts, Shadow Attorney General and former opposition leader, Lawrence Springborg, other politicians and officials on the egregious travesty of justice.

She demanded he stop ignoring them and publicly acknowledge them and publicly respond to their longstanding complaint. She again urged him to order an independent investigation into the continuous judicial abuse, judicial corruption and obstruction of justice they were repeatedly subjected to in the Queensland Discrimination Tribunal and Queensland Supreme Court where the youth was repeatedly denied legal youth advocacy and natural justice.

Her allegations courtroom audio tapes and transcripts were repeatedly severely edited to pervert the course of justice and deny them the evidence of apprehended judicial bias; judicial abuse and intimidation are corroborated by sworn statutory declarations from retired journalists.

And an independent forensic audiotape expert found considerable time missing from courtroom audiotapes due to unlawful erasure.

At the 4BC forum Mr Dick promised Ms Nash on camera he would look into her complaint, but then continued to ignore her. When the unpopular Bligh Labor government announced the “walk a day in my shoes campaign” where ministers spent one day working in the community, Ms Nash and her son approached the Attorney General at Greenslopes Newsagency where he was working on 20 September.

Ms Nash handed him a pair of her son’s old shoes to walk in and try and understand what that really feels like, which he happily accepted saying “I am happy to do that”. Mr Dick blatantly denied ignoring the family and denied breaking his promise to her he would act on their long standing complaint at the above forum despite continuing to be incommunicado.

Upon being told by Ms Nash, the family had been protesting outside John Mickel, their local member of parliament’s electorate office on denial of electoral representation and denial of political advocacy for sixteen weeks and counting, a cold and impassionate Cameron Dick can be heard telling them “that ‘s fine. That’s fine. That is what you do. You need to work through your local member. You do it through your local member of parliament. Your complaint is with him, not with me.”

Click the mp3 link above to listen to Mr Dick’s recorded conversation with them and how the aggrieved and abused young victim of crime tells Mr Dick he is a “buck passer” and “you can’t hide this forever, you can’t hide this forever dude” as Mr Dick walks back to the newsagency and away from them in the presence of a security guard.

The actual conversation with the Attorney General starts after a short 35 second delay.

The formal meeting Mr Dick promised Ms Nash following the “walk a day in my shoes campaign” took place at parliament house on 5 October 2010. However, the meeting proved extremely disappointing and a complete waste of her time. Mr Dick shirked all responsibility and denied he had the power to do anything, despite regularly intervening in legal cases in his capacity as first law officer of Queensland.

When told by the family during the meeting he had a legal obligation and a moral duty to intervene, he just kept on pontificating about the separation of powers and correct procedures, but ignored all their evidence of abuse, intimidation and the breakdown of the rule of law.

Mr Dick’s behaviour throughout the meeting was very detached, dispassionate and disinterested. He refused to assist them in any way and spoke in a cross purpose manner.

During the recorded impromptu meeting at Greenslopes he can be heard telling Ms Nash, their issue was not actually with him, but with their unaccountable local state Labor representative, John Mickel. This is very astounding given Mr Rudd referred her complaint to Premier Anna Bligh, who in turn referred Mr Rudd’s letter to Mr Dick for action.

The question must also be asked, why did then Prime Minister Rudd not refer the complaint by Ms Nash directly to the Queensland Attorney General for action, who had consistently ignored Ms Nash and who has consistently passed the buck back to her local Logan MP Mr Mickel for action, even though Mr Mickel has also been consistently incommunicado?

This seems to be a serious case of lack of accountability, lack of transparency, buck passing, breakdown of the rule of law and disgraceful inhumanity towards a young, defenceless boy!

At the 5 October meeting, Mr Dick callously referred them back to the very courts, where they say they were not heard, repeatedly abused and terrorised in harrowing hearings lasting up to 7 ½ hours without legal youth advocacy vide The Rights Of The Child.

And where their courtroom audiotapes and transcripts were repeatedly severely edited to deny them the evidence as Ms Nash told Chuck Brooks from Radio 4BC on 29 March 2007, where she described the Queensland Discrimination Tribunal as “a cesspit of corruption and abuse” and detailed the shocking abuse she and her distressed son were repeatedly subjected to  https://publish.indymedia.org.uk/media/2009/08/435571.mp3

Government doggedly refused to publicly acknowledge those comments as well and has never responded to their judicial corruption and obstruction of justice allegations in the media and on the internet.

Their response continues to be a wall of silence and that alone speaks volumes to the credibility of Ms Nash, her son and the veracity of the sworn statutory declarations by the retired journalists.

One of the four judges involved in the judicial corruption complaint is Queensland Governor, Penelope Wensley’s own brother Robert Wensley QC. Mr Wensley has since moved to Sydney. Governor Wensley and Governor General Quentin Bryce have doggedly refused to acknowledge Ms Nash and her son. Ms Bryce also refused to acknowledge the family when she was Governor of Queensland prior to her Canberra appointment.

The family has been protesting outside their local state Labor representative, John Mickel’s Hillcrest electorate office every working day for the past twenty (20) weeks on denial of natural justice, denial of electoral representation, denial of political advocacy, denial of media attention and denial of access to public service on equal terms in their very own country.

Parliamentary speaker Mickel regularly walks past them during their demonstrations or drives past in his government chauffeur driven car, pretending the family does not even exist. The opposition and parliament have been silent.

Despite a strong television, radio and newspaper media presence at the Radio 4BC forum in March, their story was suppressed, with the exception of Brisbane Times, which published a video clip showing Ms Nash talking to Mr Dick. Brisbane Times also published her related comment no. 13 in the article’s comment section underneath in full  http://bit.ly/ayUtWY

Ms Nash lodged a formal complaint about unfair misrepresentation and unjust suppression of pertinent fact against The Courier Mail in relation to two articles mentioning her and the 4BC Right to Feel Safe forum in The Courier Mail Online and The Courier Mail newspaper, which incorrectly and unjustly reported Ms Nash was walking around with a sandwich board opposing school bullying and standing silently next to the Attorney General, which is untrue. A Courier Mail cameraman had actually filmed her confronting the Attorney General and demanding he stop ignoring her.

However, the complaint was dismissed against all odds by the politicised Press Council as detailed in her citizen journalist article Australian Press Council fails judicial corruption and school bullying victim  http://bit.ly/bvw1AO

Jennifer also addressed parliament on the judicial corruption and obstruction of justice from parliament’s public gallery, but her own elected member of parliament, John Mickel shouted for her to be removed from the public gallery and denied her the right to speak and advocate for her son, as published in the foreign media article Armed Police Eject Mother From Queensland Parliament  http://mathaba.net/news/?x=620379

Courier Mail journalist Rosemary Odgers from the parliamentary press gallery interviewed Ms Nash outside parliament immediately after her violent ejection by armed police, but the incident and her grievances was also suppressed by The Courier Mail, Queensland’s only newspaper.

Queensland Police brutality has recently again hit media headlines following the u-tube release of a police surveillance video, showing the violent assault of handcuffed prisoners. Radio 4BC published the blog comments by Jennifer relating to her personal experience with police violence in parliament as under.

The Crime And Misconduct Commission (CMC) and Queensland Police Commission have also refused to investigate her complaint of police brutality during her ejection from parliament and refused to comment on her allegations:

 http://www.4bc.com.au/blogs/4bc-blog/should-the-video-have-been-released/20101013-16ih5.html

Releasing the video was necessary and Terry O’Gorman is right, incidents of police brutality against innocent citizens are much more prevalent than Police Minister Neil Roberts, who like the CMC ignored my own complaint, would have us believe.

And we should indeed all be very worried about what happens when there are no cameras recording, given the violence despite video recording. And then there is the lack of accountability, lack of transparency and lack of action on legitimate complaints! Talk about being denied a fair go and an effective remedy as per the ICCPR (1976) signed by Australia!

Shame Australian Council for Civil Liberties is not a pro-active organisation fighting for the rights of neglected and ignored Queenslanders, who are denied a voice by their elected member of parliament and the opposition on human rights abuses. And the Queensland Children’s Commissioner is so hogtied in red tape that he is only an alibi children’s advocate.

I would like an organisation, which fights for the rights of unrepresented children, who are bullied, abused, denied the right to speak, denied the right to be heard and denied the right to political advocacy and media attention in their very own country.

But I must say I really do admire the unflappable Queensland Police Union president Ian Leavers even if I don’t always agree with him. He is always there advocating for his own, no matter how bad the situation.

How I wish we had an advocate like him!

I cant overemphasise the fact that if LAW ENFORCEMENT!!! did their bloody job and actually abided by their mission statement and charter of services, I would not even have been in harms way and would not have been compelled to advocate on behalf of my son from parliaments public gallery (my comment 12/10/2010 - 8:48 PM)

I was only there because my local member, John Mickel, the speaker of parliament continues to deny us and government doggedly refuses to act.

WHY do they refuse to act? Well, the answer is all too simple, our serious judicial abuse and judicial corruption allegations are in fact the truth, the full truth AND NOTHING BUT THE TRUTH! If it werent so, then the retired journalists, my son and myself, who have all detailed and corroborated the apprehended courtroom abuse and the repeated severe and unlawful editing of courtroom audiotapes and transcripts in sworn statutory declarations, would have long been charged with lying under oath, making false, vexatious, frivolous complaints and wasting resources.

But none of us have been charged with lying and the regime does not want to publicly respond to our repeated allegations because THEY KNOW THEY ARE ALL TRUE and because THEY WANT to avoid drawing attention to this egregious travesty of justice because that would allow the rot to rise to the surface!

---When responsible authorities or those with a duty of care neglect to act appropriately to allegations when made, a proper function of the media is to invoke its role as the fourth estate and expose those allegations to the scrutiny of the public sphere--- by Susan Merrell, author of Trial by media?  http://bit.ly/bfJImy

And Louise Bellchambers  http://bit.ly/cVnaN4 is correct; Australia is obsessed with trivia, sensationalism and celebrity news!

The footage is sickening! A commentator on the news said today the CMC is asleep at the wheel and I agree! The Police Commission, CMC and Police Minister Neil Roberts ignored my own complaint on police violence, when I told them how I was violently yanked down the stairs of parliament after being ejected from the public gallery.

The incident was suppressed by the press gallery, but reported by the foreign media in Armed Police Eject Mother From Queensland Parliament.

The authorities also ignored my documented judicial abuse and corruption complaint and denied me an independent investigation into that complaint also, completely ignoring the corroborating sworn statutory declarations of eye witnesses.

I was ejected on the orders of my local MP, John Mickel, the speaker of parliament because I dared tell the truth, the full truth and nothing but the truth from the public gallery of the people’s house - NOT!!!

I was forced to advocate for a long ignored teenage human rights abuse victim because the member for Logan consistently denied him electoral representation.

This is week twenty (20) of our political protest outside his electorate office, where we face continued threats, abuse and intimidation during our protests. It is a disgrace!

We continue to be denied the fundamental right to be heard. And we continue to be denied political advocacy and mainstream media coverage in our very own country.

John Mickel walks past us during our protests and pretends we do not even exist. It is simply appalling! The opposition is equally silent.

Huston to ground control we have a problem! Are you receiving?
