This was received by email from the Vice Presidents office in Colombia. It is a response
to an email sent several weeks ago regarding Sintraemicali members murdered and imprisoned
in Colombia. (In response to a then urgent call from Colombia Solidarity Campaign on this situ.)

I dont speak Spanish but I hope someone will provide a translation in due course...

Cordial saludo
Con motivo de su comunicación relacionada con los hechos ocurridos en el departamento de Arauca en el que perdieron la vida los sindicalistas Héctor Alirio Martínez, Leonel Goyeneche y Jorge Prieto, nos permitimos informarle que es interés del Gobierno que este caso se trate dentro de la mayor transparencia y que obre la acción de la Justicia en la búsqueda del esclarecimiento y la verdad.
Es así, como esta investigación fue asumida por la Justicia Ordinaria a través de la Unidad de Derechos Humanos de la Fiscalia General de la Nación, sede Bogotá, bajo el radicado 2009, la cual en su etapa preliminar y de recolección de pruebas el día 6 de agosto del año en curso, el Fiscal Especializado que conoce del caso se trasladó al sitio de los hechos con el apoyo del Fiscal de Derechos Humanos de Cúcuta y Arauca en compañía de funcionarios del CTI sección criminalística e inmediatamente se iniciaron las labores respectivas; igualmente en representación del Ministerio Público actuaron la Personería Municipal y del Procurador Judicial de Saravena.
Allí se procedió durante varios días a la ubicación y recepción de declaraciones juradas, inspección judicial en la escena de los hechos, toma de muestras patrones de las armas, revisión de expedientes judiciales, exhumación de los cadáveres que implico el desplazamiento desde Bogotá a Saravena de laboratorios portátiles y equipo de excavación con intervención de un patólogo forense de Medicina Legal de Bogotá.
Con base en lo anterior, la Unidad de Derechos Humanos de la Fiscalia, inicio la etapa de instrucción y resolvió la situación jurídica ordenando la detención preventiva de un oficial y 2 soldados del Ejercito Nacional, también contra un civil, de la siguiente manera: Orden de captura 004276 al subteniente Juan Pablo Ordóñez Cañón, Orden de captura 4279 al soldado profesional Oscar Saúl Cuta Hernandez, Orden de captura 4278 al soldado profesional Jhon Alejandro Hernandez Suárez y orden de captura 4277 al civil Daniel Caballero Rozo, tal decisión fue fechada 6 de septiembre del 2004. Es de señalar que las ordenes de capturas se hicieron efectivas y las personas mencionadas se encuentran detenidas.
Así mismo, el Despacho del Procurador General de la Nación asumió directamente el caso en lo disciplinario y por parte de la Procuraduría Delegada para el Ministerio Público se constituyó la Agencia Especial N° 6908 en cabeza de la Procuraduría 30 Judicial Penal II de Bogotá a fin de que intervenga en el proceso que adelanta la Unidad Nacional de Derechos Humanos.
Por otra parte, los sindicalistas en mención, Jorge Prieto Chamusero era requeridos según orden de captura N° 1812 del 19 de agosto de 2003, Leonel Goyeneche Goyeneche orden de captura 1828 del 19 de agosto de 2003 y Héctor Alirio Martínez solicitado con orden de captura N° 1830 del 19 de agosto de 2003 expedidas por la Fiscalía General de la Nación, por el delito de rebelión.
También fueron capturados Samuel Morales Flores solicitado con orden de captura N° 1810 del 19 de agosto de 2003 y Maria Raquel Castro solicitada con orden de captura 1817 del 19 de agosto de 2003 por el delito de Rebelión. Estas personas fueron puestas a disposición de la Fiscalia General de la Nación.
Así mismo, es de señalar que el día 24 de agosto del presente año, se realizó en la ciudad de Arauca una reunión para analizar la situación de derechos humanos de los trabajadores en el departamento de Arauca la cual estuvo presidida por el Señor Vicepresidente de la Republica con presencia de los representantes de las Centrales sindicales CUT, CGTD, CTC y las diferentes autoridades regionales, suscribiéndose un acuerdo que plantea esperar las conclusiones de la investigación que actualmente adelanta la Unidad de Derechos Humanos de la Fiscalia General de la Nación y confiando en que esta se adelante con la mayor celeridad posible dentro de los términos legales.
También se acordó desarrollar reuniones entre el Gobernador, la Fuerza Pública, los dirigentes sindicales, las organizaciones sociales y defensoras de derechos humanos, para abordar los temas de las Garantías para el Trabajo Sindical, archivos de inteligencia y los mecanismos de interlocución permanente; la primera reunión se realizará el próximo 22 de septiembre de los corrientes.
Deseamos resaltar que nuestra Fuerza Pública tiene un profundo respeto por los derechos humanos y el compromiso de proteger a toda la población, tal como lo percibe el pueblo colombiano. Es así como este hecho aislado ha sido investigado y la justicia viene actuando con la rigurosidad de un Estado comprometido en la plena vigencia de los derechos de todos los ciudadanos.
Por lo tanto, el Gobierno respalda y respeta las decisiones de las autoridades judiciales y producto de dichas decisiones se adoptarán las medidas pertinentes. Adicionalmente reiteramos el compromiso de ofrecer las garantías necesarias para el desarrollo de la actividad sindical y la aplicación de una política de seguridad con transparencia y el compromiso solidario de los ciudadanos, en aras del fortalecimiento de nuestra democracia.
